Welcome to Carbyne Sports LLC ("we," "us," or "our"), an online retail clothing brand specializing in high-performance martial arts and grappling apparel. Our website (Carbyne Sports) is powered by Shopify and offers products like the Nucleus Training Top, Revival Kimono, and Training 2.0 No Gi Shorts. These Terms and Conditions ("Terms") govern your access to and use of our website, products, services, email/SMS communications, promotions, and any related features (collectively, the "Services").

By accessing or using our Services, placing an order, or creating an account, you agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein. If you do not agree, please do not use our Services. We reserve the right to modify these Terms at any time, with changes effective upon posting. Your continued use constitutes acceptance of updates.

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. We are located in Nashville, Tennessee, and any disputes will be resolved in the courts of Davidson County, Tennessee.

2. Ordering and Purchases

  • Product Availability: All products, such as our Competition Rank Tops or Aether Canvas Kimonos, are subject to availability. We may limit quantities or discontinue items without notice. Prices and descriptions are subject to change; we are not responsible for typographical errors.
  • Order Process: Orders are placed through our Shopify-powered checkout. By submitting an order, you authorize us to charge your payment method for the total amount, including taxes, shipping, and any applicable fees.
  • Payment: We accept major credit cards, PayPal, and other methods via secure third-party processors. Payment information is handled in accordance with our Privacy Policy. You represent that your payment method is valid and authorized.
  • Order Confirmation and Cancellation: Orders are not binding until we send a confirmation email. We reserve the right to cancel orders due to pricing errors, stock issues, suspected fraud, or violations of these Terms. If canceled, we will refund any payments.

3. Shipping and Delivery

  • Shipping Costs: Costs are calculated at checkout based on weight, destination, and method. Free shipping may apply to promotions (e.g., our storewide super sales up to 30% off).
  • Risk of Loss: Title and risk of loss transfer to you upon delivery to the carrier. We are not responsible for lost, stolen, or damaged packages once shipped, but we may assist with claims.
  • International Shipping: Additional fees, taxes, or delays may apply. You are responsible for compliance with local laws.

4. Returns, Refunds, and Exchanges

  • Return Policy: We offer returns or exchanges for most unused, unworn items in original packaging within 30 days of delivery. Items like custom or clearance products (e.g., during our storewide super sale) may be final sale. Contact us via support ticket for a return authorization.
  • Process: Return shipping is at your expense unless the item is defective or we made an error. Refunds are issued to the original payment method within 7-10 business days of receipt, minus any shipping/handling fees.
  • Defective Items: If a product (e.g., our Training 2.0 No Gi Top) arrives damaged or defective, notify us within 7 days for a free replacement or refund, including return shipping.
  • Exclusions: No returns on personalized items, undergarments, or items marked as final sale. We reserve the right to deny returns for abuse.

5. Intellectual Property

  • Ownership: All content on our site, including text, images, logos, product designs (e.g., our Carbyne No Gi Top designs), and trademarks, is owned by us or our licensors. You may not copy, reproduce, distribute, or create derivative works without written permission.
